Terms of Service

These terms of service ("Terms") govern your use of Sightaro products and services ("Service") provided by Goatee Productions Oy ("Company", "we", "us").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Sightaro is a multilingual onboard announcement system for ships and tourism operators. The Service includes the Sightaro software product, associated documentation, the support portal (bug reports, feature requests), and any related online services.

2. Account Registration

Some features of the Service require an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating an account.

3. License and Usage

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. This license does not include the right to:

• Reverse engineer, decompile, or disassemble the software.
• Modify, adapt, or create derivative works from the Service.
• Redistribute, sublicense, or make the Service available to third parties without authorization.
• Use the Service for any unlawful purpose or in violation of applicable regulations.

4. Acceptable Use

You agree not to:

• Use the Service in any way that violates applicable local, national, or international law.
• Submit false, misleading, or malicious content through the support portal.
• Attempt to gain unauthorized access to the Service, other user accounts, or related systems.
• Interfere with or disrupt the integrity or performance of the Service.
• Use automated systems (bots, scrapers) to access the Service without prior written consent.

5. Intellectual Property

All intellectual property rights in the Service, including software, design, trademarks, and content, are owned by Goatee Productions Oy. Nothing in these Terms transfers any intellectual property rights to you beyond the limited license granted above.

6. User Content

Content you submit through the Service (bug reports, feature requests, files) remains yours. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, display, and process that content solely for the purpose of operating and improving the Service.

7. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or secure. Use of the Service in safety-critical maritime applications is at your own risk, and you are responsible for compliance with applicable maritime regulations.

8. Limitation of Liability

To the maximum extent permitted by applicable law, Goatee Productions Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.

Our total aggregate liability arising from or related to these Terms or the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless Goatee Productions Oy, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, indemnification, and governing law survive termination.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated through our website or by email at least 30 days before taking effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of Finland, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of Helsinki, Finland.

If you are a consumer within the European Union, you may also use the European Commission's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

13. Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
